The DRAW project has been running since 2014. The team is part of Portsmouth, East Hampshire & Isle of Wight GP Education, a division within the Wessex Postgraduate Medical Deanery. We are based at St James's Hospital in Portsmouth.

The DRAW project was devised by Dr Alex Macdonald. It is delivered by her and another Programme Director, Dr Bryony Sales.

The copyright for every drama excerpt that might be used in a DRAW session resides with the copyright holder for that drama, of course, whether the BBC or another party. UK law permits the use of copyrighted material without licence in circumstances known as fair dealing under sections 29 and 30 of the Copyright, Designs and Patents Act 1988. US law permits similar use under the term fair use.

The defence of fair dealing requires two conditions to be met: (1) that the circumstances of use of the material fall into one of the following categories: research and study, criticism or review (including the thought or philosophy of the work), current events, parody or caricature or pastiche, and quotation, and (2) that the dealing within that category should be fair. Fairness here would normally include full acknowledgement, no negative impact upon commercial sales of the original, limited extracts of the original, etc.

In our case, we contend that the rules of fair dealing are met in that (i) the use of the video clips within a DRAW role-play and class discussion amounts to a criticism or reassessment or moral review of the action depicted in the video in a non-commercial educational setting. In that sense it is transformative, diverging entirely from the original entertainment purpose of the work; (ii) the excerpts are small parts of the total work; (iii) the original work is fully acknowledged; (iv) no opportunity is provided for participants to make copies of the original material; (v) it is our direct experience that participants in a DRAW session are often minded to purchase the original work (hitherto unknown to them), resulting in a positive impact on commercial sales.
